Back on Track Program

Back on Track or BOT is a safe driving initiative of the Miami-Dade Office of the State Attorney.  Under this program, eligible first time Driving under the Influence (DUI) offenders completing the program will have an opportunity to receive a withhold of adjudication on a reduced charge of Reckless Driving.

Eligibility is determined by the State Attorney’s Office and based on the client’s criminal history, driving history, and circumstances surrounding the DUI arrest.  There are two tiers available for this program; Tier 1 for those offenders who have a breath/blood alcohol level under .15 at the time of the DUI arrest, and Tier 2 for those offenders who refuse a breath, blood or urine test or have a breath/blood alcohol level of .15 or higher.  The costs and conditions of the program vary depending on the Tier.

Completion of the BACK ON TRACK program does not result in the dismissal of your DUI charges.

Upon successful completion of the program, the DUI charge will be amended to a reckless driving with a withholding of adjudication. That would mean that you would receive no points and could be eligible to have your arrest and criminal records sealed.

If the State Attorney determines that you are a candidate for the Back on Track program, you will fall into either Tier 1 of Tier 2.

TIER ONE: (For clients with a Breath/Blood Alcohol Level below .15)

  • The term of the program will be 6 months of which you must report monthly and submit to random alcohol and drug testing.
  • You must complete DUI School within the first 3 months of the program.
  • You must complete a substance abuse evaluation, conducted by the DUI School, within 1 month of enrollment, and treatment if mandated within the term of the program.
  • You must complete 40 hours of community service.
  • You must complete a 2-hour Victim Impact Panel Class and the online YouImpact Program.
  • You must install an ignition interlock system on your vehicle for three months during the term of the program.
  • You will be required to pay:
    • $500.00 for the cost of supervision
    • $300.00 towards a victim services/enforcement fund donation
    • $50.00 towards the cost of prosecution
    • DUI School, drug testing fees, and treatment fees (if necessary) as required by the provider
    • Cost recovery to law enforcement as determined by your case
    • Court Costs

TIER TWO: (For clients with a Breath/Blood Alcohol Level of .15 or above or those who refuse a breath, blood or urine test)

 

  • The term of the program will be 9 months of which you must report monthly and submit to random alcohol and drug testing.
  • You must complete DUI School within the first 3 months of the program.
  • You must complete a substance abuse evaluation, conducted by the DUI School, within 1 month of enrollment, and treatment if mandated within the term of the program.
  • You must complete 60 hours of community service.
  • You must complete a 2-hour Victim Impact Panel Class and the online YouImpact Program.
  • You must install an ignition interlock system on your vehicle for six months during the term of the program.
  • You will be required to pay:
    • $650.00 for the cost of supervision
    • $500.00 towards a victim services/enforcement fund donation
    • $50.00 towards the cost of prosecution
    • DUI School, drug testing fees, and treatment fees (if necessary) as required by the provider
    • Cost recovery to law enforcement as determined by your case
